Former President Trump announced Thursday morning that his defense team in the NY v. Trump case has filed a motion to appeal the “unconstitutional gag order” that was imposed on the 45th president, restricting what he can publicly say about the case.“I just want to let you know that we’ve just filed a major motion in the appellate division concerning the absolutely unconstitutional gag order, where I’m essentially not allowed to talk to you about anything meaningful that’s going on in the case. And many good things are going on with the case. It shouldn’t have been filed,” he said.
Legal experts have made many arguments against this gag order. While gag orders are used occasionally, using one against the Republican presumptive nominee during an election year as the defendant in a case is unheard of.
What makes it worse is the behavior of the prosecution’s witnesses. Michael Cohen, who has been convicted of fraud, has been allowed to say anything negative about Trump that he wants and fundraise on TikTok. Stormy Daniels has made mountains of money on her accusations, and was sickeningly paraded on the stand this week with no penalty from the judge.
Judge Merchan seems to have it out for Trump, treating him prejudicially and not allowing him to defend himself against public allegations. But Trump seems to be handling it well, exercising what he believes are his Constitutional rights by speaking out and filing a legal appeal of the gag order.
Most are unsure how this case, or any other, will shake out before judge and jury, but many experts are confident that a more mature appellate court will vindicate Trump. But that doesn’t seem to be the point. Democrats look like they want to tar and feather Trump before the election, with the ability to call him a convict or even land him behind bars.
