Republican Reveals “No-Brainer” Way to Curb Activist Judges, Calls on Congress to Revoke Power

Remember when we elected a president to actually enforce our laws? Well, it seems a bunch of activist judges didn’t get the memo. Across America, unelected judges with lifetime appointments are wielding their gavels like scepters, blocking President Trump’s agenda at every turn despite the clear mandate voters gave him in 2024.

It’s become a predictable circus act – Trump signs an executive order, and before the ink dries, some Democrat-appointed judge somewhere issues a “nationwide injunction” rendering it useless. Never mind that millions of Americans voted for precisely these policies. These black-robed tyrants seem to think their personal opinions trump the ballot box (pun absolutely intended).

Missouri Senator Josh Hawley has had enough of this judicial overreach and is taking bold action to stop it. During an appearance on Fox News’s “The Ingraham Angle,” Hawley laid out his frustration with district court judges who are abusing their authority through nationwide injunctions:

“The key thing to do here, Laura, is to end the ability of these district courts to abuse their judicial authority by issuing these so-called nationwide injunctions,” Hawley told host Laura Ingraham. “I don’t think they have that authority, properly speaking, under the Constitution, Article III. What they’re doing is they’re purporting these judges, they’re purporting to go out, and to bind parties and individuals who aren’t before them [in their districts].”

Putting Judges Back In Their Constitutional Lane

Hawley isn’t just complaining – he’s offering a solution. The senator has introduced the “Nationwide Injunction Abuse Prevent Act of 2025,” legislation designed to strip district courts of their self-appointed power to issue sweeping nationwide injunctions.

“Unelected district judges are usurping the authority of a duly-elected president and dictating national policy for 330 million Americans,” Hawley said in a statement accompanying the bill. “Congress must stop this unconstitutional weaponization of the judiciary. My bill would be a critical step toward doing just that.”

The evidence of judicial obstruction is staggering. In February alone, liberal judges slapped the Trump administration with an unprecedented 15 nationwide injunctions. That’s more than one every other day!

The Gang That Got A Free Return Flight

One particularly egregious example of judicial overreach came when President Trump invoked the Alien Enemies Act of 1798 to accelerate deportation of dangerous Tren de Aragua gang members. U.S. District Judge James Boasberg of the District of Columbia issued an injunction requiring the Trump administration to bring back two planes of gang members who were already on their way to El Salvador.

Yes, you read that correctly – a single judge ordered violent gang members to be flown BACK to the United States after they’d already been deported.

Democrats’ Convenient Change Of Heart

Hawley pointed out the stark hypocrisy from across the aisle on this issue.

“I noticed that the Democrats, just a few months ago, before the election of Donald Trump, were complaining bitterly about Republican-appointed judges issuing nationwide injunctions,” Hawley said. “So I had to say this. Let’s have a vote. They said they wanted to eliminate nationwide injunctions seven months ago. OK. Let’s do it.”

The senator’s bill would clarify that a district judge’s order only applies to the parties in the case or within the local judicial district—not to the entire nation. This would allow the Executive Branch to effectively pursue a national policy agenda without unreasonable obstruction.

Hawley emphasized that Congress has the constitutional authority to make this change: “The Constitution expressly gives to Congress the ability to create the lower courts. The lower courts are not in the Constitution, per se. Congress has the ability to create them, to govern them.”
