After NASCAR Gets Pressure Over ‘Diversity Internship’ – They Wave the White Flag and Shut It Down

Many companies are facing a harsh reality when their customers discover employment requirements excluding people based on race. This is well-established law that has been in place for decades. Why some companies are now trying to circumvent this law is baffling.

One popular company was called out for its posting of a job opportunity that excluded the majority of its fan base. The job description didn’t go over well, and corrections had to be made.

Widely popular racing organization NASCAR was caught supporting a racial requirement for its “diversity internship program.” Details of the program that discriminated against one race were exposed by a conservative news outlet.

The stock car racing giant required applicants for an internship program to be a member of specified non-white “minority classifications,” but that provision was removed after experts told The Daily Wire it was “blatantly illegal” discrimination.

The job post, according to The Daily Wire, required applicants to, “Be a member of one or more of the following races/ethnic minority classifications: Black or African American, American Indian or Alaska Native, Asian, Latino or Hispanic, Native Hawaiian or Other Pacific Islander.” The job post no longer appears online with that requirement.

Not surprisingly, The Daily Wire reported that NASCAR did not respond to a request for comment. The race-based job posting didn’t go over well with at least one legal expert, David Bernstein, a professor at George Mason University’s Antonin Scalia School of Law.

Bernstein told the news outlet that the race requirement was “blatantly illegal,” explaining that it would “seem to violate Title VII and the 1866 Civil Rights Act.” Applicants unable to apply on the basis of race could have grounds for a lawsuit against NASCAR.

The Daily Wire dug deeper into the racing organization’s calls for diversity and discovered more programs that seemed to discriminate based on race. These include the “drive for diversity,” which also includes the “driver development program” and the “pit crew development program.”

These programs appear to remain in place where NASCAR requires participants to be either female or a “member of one or more … ethnic minority classifications.” The classifications, according to The Daily Wire, are listed as including African American, Asian, Hispanic or Latino, Native American, Native Hawaiian or Pacific Islander, and two or more races.
