A federal court on Thursday ruled that it is unconstitutional to ban Americans accused of domestic violence from possessing firearms, even if they’re subjected to restraining orders.
Applying the logic the U.S. Supreme Court put forward last summer in deciding a landmark Second Amendment case, a panel of three judges on the 5th U.S. Circuit Court of Appeals unanimously agreed that the federal ban on possessing a firearm while subject to a domestic violence restraining order should no longer be considered constitutional.
This will really get Democrats foaming at the mouth! The court ruled that a law banning Americans accused of domestic violence from possessing firearms was unconstitutional. This means that a person who otherwise had not broken the law cannot be denied the right to bear arms.
Now, liberals are going to be very upset about this. That’s because they immediately assume someone who has been accused of this kind of behavior is automatically going to use a gun to harm someone. Pretty prejudice of them, isn’t it?
We’re not talking about people convicted of actual dangerous behavior. We’re simply talking about someone who might have been accused of something by a former partner. Maybe they have a restrainer order out on them. But they haven’t been convicted of a crime in a court of law.
Democrats seem to be discriminating against people, because of a bad relationship. In the past, the U.S. government prevented certain groups from obtaining firearms, such as American Indians, over similar, unprovable claims. But the 5th Circuit stood by the Supreme Court’s decision and knocked down this law.
Don’t be surprised if Democrats try to challenge this ruling. For them, it’s not about keeping people safe. It’s about getting as many people gunless as possible. The left’s dream is to stamp out the Second Amendment, so Americans will have no means to defend themselves.
But, at the very least, patriots are winning this fight.
