Joe Biden’s censor-happy administration just took another blow on the chin. His efforts to chill free speech through modern-day communications platforms just got hobbled by a federal court.

People in today’s world spend more time chatting about hot topics on social media than any other means of communication. The free flow of news and ideas across the internet supports free speech afforded by the Constitution.

When Joe Biden and his administration don’t like what people are talking about, they work to stop constitutionally protected free speech. In a recent court case Biden and company got slapped with a heavy court order for their dealings with social media companies.

On Tuesday, the Fifth Circuit Court of Appeals extended the scope of an injunction in place that limits the Biden administration’s communication with big tech companies to include the Cybersecurity and Infrastructure Security Agency (CISA) within the Department of Homeland Security.

The case in question deals with how a top agency within the Department of Homeland Security, CISA, coordinated with social media companies to effectively censor “election-related speech.” The federal court determined that this likely violates the First Amendment.

Several states joined in the lawsuit for the alleged censorship. GOP Missouri Attorney General Andrew Bailey is leading the litigation against the Biden administration. He has called the CISA the “nerve center” of the White House’s “vast censorship enterprise” and “the very entity that worked with the FBI to silence the Hunter Biden laptop story.”

Plaintiffs want the Biden administration held accountable for its actions. The case points out alleged abuses of CISA directives for protecting Americans.

“CISA was created to protect Americans from foreign attack, and now it has begun targeting its own citizens,” Bailey said.

Plaintiffs were awarded the injunction based on the decision of a three-judge panel at the Fifth Circuit. Judges ruled that CISA was the “primary facilitator” of the FBI’s interactions with the social media platforms and worked in close coordination with the FBI to push the platforms to change their moderation policies to cover “hack-and-leak” content.

Details of the injunction decision showed a scathing assessment from the judges. The Biden administration and its various agencies were determined to be deeply involved in restricting American’s free speech.

“CISA used its frequent interactions with social-media platforms to push them to adopt more restrictive policies on censoring election-related speech,” the court order reads. “And CISA officials affirmatively told the platforms whether the content they had ‘switchboarded’ was true or false.”

The injunction order compared the government’s actions during the pandemic as akin to “an Orwellian ‘Ministry of Truth.'” The order continued by describing the government’s actions as arguably involving “the most massive attack against free speech in United States’ history” that “blatantly ignored the First Amendment’s right to free speech.”
