What happens if the prosecutor gets prosecuted? Does he walk away freely, or must he go to jail, directly to jail? The radical leftist prosecutor attacking former President Donald Trump may have drawn up the wrong indictment in this high-stakes game of “get Trump.”
And if this legal theory holds, he may be facing jail time. As any prosecutor should know, false charges can bring about severe consequences. If Special Counsel Jack Smith doesn’t win his case against Trump the tables could be quickly turned. Wouldn’t that be justice?
Harvard law professor Alan Dershowitz is no fan of Trump, but he is a true constitutional scholar who hates injustice and the abuse of the legal system. He believes the charges leveled against Trump by Smith could be used against the special prosecutor if Trump is proven right under the First Amendment to make his Jan. 6 speech and take the actions he did.

“The statute says the following, two or more persons conspire to injure and deny somebody the free exercise or enjoyment of any right or privilege secured him by the constitution,” Dershowitz said. “Then Jack Smith will have conspired to deny him of that right. That’s how serious this is.”
Dershowitz has a gift for cutting to the quick to decipher “legalese” that prosecutors love to use when charging clients. He made it clear that Smith is also deliberately leaving out key words from Trump’s speech that don’t support any “conspiracy” charges. Dershowitz called Smith’s actions “malicious.”

“What (Trump) said was, ‘I want you to assemble peacefully and patriotically,’” Dershowitz added. “Jack [Smith] leaves that out. That is a lie, a lie, an omission lie and if you’re going to indict somebody for telling lies, don’t tell lies in the indictment.”
This may be the ace up Trump’s sleeve that saves him from the radical left’s attempts to throw him in jail and keep him off the campaign trail. Smith appears to be trampling all over Trump’s constitutional rights and trying to set legal precedent where he can attack anyone who speaks out against the government.

“If you’re going to indict somebody for denying people their constitutional rights, don’t deny them their constitutional rights by indicting them for free speech,” Dershowitz said. “That’s how hypocritical this is.”
Dershowitz also called out Smith’s pushing the boundaries of the law by attacking Trump’s attorneys as “unindicted co-conspirators.” Every citizen has a right to counsel under the Sixth Amendment and targeting attorneys as criminals for providing legal advice stomps on the Constitution.

“This is a very, very dangerous indictment, dangerous to the First Amendment and also dangerous to the Sixth Amendment,” Dershowitz said.
Once again, a leftist’s hatred of Trump may have blinded him to the dangers of abusing the legal system to punish a political opponent. Smith may have overplayed his hand when Trump could still draw the legal win that turns Smith into the indicted and possibly send him to a jail cell.
