Retailers in California arguably face more government intrusion and greater tax burdens than most other states. Now California lawmakers are foisting another “insane” law on retailers that forces them to follow government rules for selling to children.
This latest tort mandates that retailers follow the law or face fines. Stores must reorganize in a way the government mandates to keep them from losing more of their profits. The law follows the government-enforced culture changes sweeping across California.
Retailers, who are in the busiest season of the year, have just days to comply with the new law. California is forcing stores that sell children’s items to have a gender-neutral section, according to a state government website and compliance is mandatory on Jan. 1.
Any story selling “childcare items” or toys, according to the Daily Caller, and employs a minimum of 500 employees across store locations must comply. The law requires creating a store section where “a reasonable selection of the items and toys for children that it sells shall be displayed, regardless of whether they have been traditionally marketed for either girls or for boys.”
Stores that do not comply with the law could face a civil penalty and charged $250 after the first offense or $500 for later offenses.
Translating the rambling text of the law can be confusing. In part, the law refers to “unjustified differences in similar products” that “traditionally” are marketed to either girls or boys “can be more easily identified by the consumer if similar items are displayed closer to one another in one.”
The law requires applicable stores to develop an undivided area of the retail sales floor for identified toys. Keep such toys separated, the law states, makes it difficult for the consumer to “compare the products and incorrectly implies that their use by one gender is inappropriate.”
This new law is part of a rash of bills signed into law this year by Democratic California Gov. Gavin Newsom that deals with gender ideology. One bill requires the State Department to develop an “LGBTQ cultural competency training” by July 1, 2025, while another creates an advisory task force to identify policies to assist LGBTQ students.
