What’s Happening:

California lawmakers’ continued attempts to undermine the Constitution keep running into roadblocks in the judicial system. There are certain constitutional rights that local or state governments can’t take away from American citizens.

The problem is that California lawmakers don’t seem to care about citizens’ rights with the number of laws the state has passed that infringe on those rights. Once again, a federal judge closed the road on California’s attempt to strip away Second Amendment rights.

The latest legal beat down came on Friday when a California law banning possession and sale of gun magazines holding more than 10 rounds was shot down as unconstitutional. U.S. District Court for the Southern District of California Roger Benitez wrote in an extensive and detailed ruling that law-abiding citizens had constitutional rights to own these types of magazines.

Benitez made it clear that California did not justify “its sweeping ban and dispossession mandate,” and that “removable firearm magazines of all sizes are necessary components of semiautomatic firearms.”

“Therefore, magazines come within the text of the constitutional declaration that the right to keep and bear arms shall not be infringed,” Benitez wrote.

Benitez continued by stating that “millions of removable firearm magazines” that are able to hold between 10 and 30 rounds are “commonly owned by law-abiding citizens for lawful purposes, including self-defense.” The magazines are therefore presumptively within the protection of the Second Amendment, he stated.

A key element of Benitez’s ruling is how he pointed out that one government solution to stopping a few mad men with guns by denying the rights of “responsible, law-abiding people” isn’t constitutional. He stated that there is support for “state laws against the use or misuse of firearms with unlawful intent, but not the disarmament of the law-abiding citizen.”

How did California respond to the ruling? The states’ dear governor – liberal Gavin Newsom – quickly insulted Judge Benitez by calling him a “right-wing zealot with no regard to human life.”

That’s Cali for you: deny rights and attack the level-headed judges who maintain the sanctity of the Constitution. People need to wake up to the fact that gun controllers will never give up trying to take away God-given rights of the American people.
