Florida Judge Cannon Tosses Confidential Documents Case Against Trump After SCOTUS Decision

The Supreme Court continues to issue rulings striking back the Biden administration. The conservative court has rolled back decisions made by this president. In some cases, the court has shut down radical, liberal schemes that have been around for decades.

It ended legalized abortions on the national level. And it shut down affirmative action, a particularly favorite scheme by woke Democrats.

Recently, it issued several rulings that threw wrenches in Biden’s plans against Trump. Those rulings are already having a sweeping effect on the country. The federal judge presiding over Jack Smith’s case against Trump considered those rulings. And, in a bombshell decision, she is shutting down a major attack against the former president.

From Breitbart:
A federal judge in Florida threw out the prosecution of former President Donald Trump on Monday in the “documents” case because she ruled that Special Counsel Jack Smith had not been appointed in a constitutional or lawful manner…

In the end, it seems the Executive’s growing comfort in appointing “regulatory” special counsels in the more recent era has followed an ad hoc pattern with little judicial scrutiny.

Judge Aileen Cannon threw out the federal case against Trump over documents kept at Mar-a-Lago. The judge decided that the DOJ unlawfully appointed Special Counsel Jack Smith. She said it was unconstitutional, since he had not been approved by Congress.

Smith had served as a U.S. attorney during the Obama administration. But he resigned that post and was serving as a lawyer for foreign entity The Hauge. Merrick Garland violated the Appointments Clause of the Constitution when he picked this man instead of a serving U.S. attorney.

That was the strongest reason Judge Cannon dismissed the case. She referenced several previous cases to support her decision, including recent key rulings from the Supreme Court. Supreme Court Justice Clarence Thomas, in a recent opinion, speculated that Smith’s appointment was likely unconstitutional. This opened the door for Cannon to make her ruling.

Democrats were counting on this case to shut down Trump—claiming it wasn’t covered by presidential immunity. This entire sage began in 2022, when Biden’s DOJ shocked the nation by raiding Trump’s home in Mar-a-Lago. The liberal media had a field day, jumping on this unprecedented event to make Trump look as guilty as possible.

Many experts claimed this case held no water, yet Jack Smith pushed it. He had been called out for convening a grand jury in Washington not Florida. And the judge had reprimanded him for possible evidence tampering.

Now that this case has been thrown out, there is a possibility that the other trials against Trump will fall apart.

Key Takeaways:

  • Federal Judge Cannon threw out the documents case against Donald Trump.
  • The judge ruled that Special Counsel Jack Smith’s appointment was unlawful and unconstitutional.
  • Attorney General Garland chose him, without approval from Congress.
